Terms and Conditions

Article 1 — Definitions

In these terms, the following definitions apply:

• Contractor: Freddi Media, located in Nieuwegein, CoC 93287259
• Client: the natural or legal person who commissions work
• Assignment: the agreement between client and contractor

Article 2 — Applicability

These terms apply to all offers, quotes and agreements between Freddi Media and client.

Article 3 — Quotes

• All quotes are non-binding and valid for 30 days, unless stated otherwise.
• Prices are exclusive of VAT, unless stated otherwise.
• An assignment is established after written or digital confirmation by both parties.

Article 4 — Execution

• We carry out the assignment to the best of our ability.
• The client provides all necessary information and materials in a timely manner.
• Changes to the assignment may lead to adjustments in price and delivery time.

Article 5 — Delivery time

Stated delivery times are indicative. Exceeding the delivery time does not entitle the client to compensation or termination of the agreement.

Article 6 — Payment

• Payment must be made within 14 days of the invoice date.
• For larger projects, a 50% down payment may be required.
• In case of late payment, the client is in default and we may suspend work.

Article 7 — Intellectual property

• Copyright on designs and code remains with Freddi Media until full payment.
• After full payment, usage rights are transferred to the client.
• We retain the right to use the work for promotional purposes.

Article 8 — Liability

• Our liability is limited to the amount of the assignment.
• We are not liable for indirect damage or consequential damage.
• The client is responsible for the content placed on the website.

Article 9 — Hosting and maintenance

Additional terms apply to hosting and maintenance subscriptions:

• Subscriptions are entered into for a minimum of 1 month.
• Cancellation must be made at least 1 month before the end of the period.
• In case of late cancellation, the subscription is tacitly renewed.

Article 10 — Cancellation

• Cancellation before commencement of work requires payment of 25% of the quote.
• Cancellation during work requires payment of hours already worked.

Article 11 — Disputes

Dutch law applies to all agreements. Disputes are submitted to the competent court in the district where Freddi Media is located.
